Terms and Conditions - Salty Soul Tours

1. Agreement

These Terms and Conditions apply to all bookings made with Salty Souls Tours Pty Ltd (“Salty Souls”, "Company", “we”, “us”, or “our”).

By making a booking, you confirm that you have read, understood, and agree to these Terms. 

2. Booking Requirements

By using this website or making a booking with Salty Souls, you confirm that:

  • You are at least 18 years of age and legally able to enter into a binding agreement.
  • The information you provide during the booking process is accurate and complete.
  • You will comply with these Terms and all applicable laws and regulations.

If you make a booking on behalf of other travellers, you confirm that you are authorised to act for them and accept these Terms on their behalf. 

3. Bookings & Payment

To make a reservation, you must complete the booking process and pay the amount shown at checkout using the available payment methods.

Your booking is confirmed only after full payment has been successfully processed and you receive written confirmation from Salty Souls.

All prices on the website are quoted in United States Dollars (USD), unless otherwise stated.

Salty Souls reserves the right to adjust pricing due to changes in fuel costs, government-imposed taxes, or other unforeseen operational costs, with reasonable prior notice.

4. Travel Insurance

Salty Souls strongly advises all guests to obtain comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, personal liability, and loss of personal belongings prior to departure.

The Company accepts no liability for costs incurred as a result of a guest's failure to obtain adequate travel insurance.

 

5. Voluntary Acceptance of Risk

By joining a Salty Souls expedition, you acknowledge that outdoor and ocean travel involves inherent risks that cannot be completely eliminated.

Activities such as boating, swimming, snorkelling, kayaking, and travelling in remote areas may involve risks including injury, illness, property damage, or other unforeseen events.

Where legally permitted:

  • You voluntarily accept and assume the risks associated with expedition travel and marine activities.
  • You take personal responsibility for your safety, including using safety equipment and following crew instructions.
  • You release Salty Souls from liability for injuries, losses, or damages arising from participation, except where caused by gross negligence or wilful misconduct. 

6. Cancellation Policy

All cancellations, refunds, and rescheduling conditions are governed by the Salty Souls Cancellation & Refund Policy, which is published separately on this website.

By completing a booking, you acknowledge that you have read and accepted that policy.

7. Health & Fitness

Expedition travel may involve physical activities and remote environments.

You are responsible for ensuring that you are medically fit to participate in activities such as swimming, snorkelling, kayaking, hiking, and boarding small boats.

If you have any medical condition that may affect your participation, you must seek medical advice and notify us prior to departure.

Salty Souls may refuse participation in any activity if it believes there is a safety risk.

8. Safety & Conduct

Guests must follow all instructions provided by the captain, guides, and crew.

Unsafe behaviour, harassment, illegal conduct, or actions that endanger others may result in removal from the expedition.

Removal due to misconduct will occur without refund and at the guest’s expense.

9. Meals & Dietary Requirements

Meals may be prepared using local ingredients during the expedition.

Guests must inform Salty Souls of any dietary restrictions or allergies prior to departure.

While reasonable efforts will be made to accommodate dietary requirements, a completely allergen-free environment cannot be guaranteed.

10. Third-party Suppliers

Some services during the expedition may be provided by independent third-party suppliers, including boat operators, accommodation providers, transport services, and local guides.

These suppliers operate independently and are not under the direct control of Salty Souls.

Salty Souls is not responsible for the acts, omissions, or performance of any third-party supplier.

11. Personal Belongings & Valuables

Guests are advised not to bring items of significant value on the expedition.

Salty Souls accepts no responsibility for the loss, theft, or water damage of electronics, documents, jewellery, or other personal valuables.

Guests are strongly encouraged to use waterproof or dry bags to protect their belongings. While Salty Souls may provide dry bags upon request, availability cannot be guaranteed.

12. Itinerary Changes

Salty Souls reserves the right to modify the expedition itinerary at any time before or during the journey due to weather, safety, operational, or logistical reasons.

Modified itineraries do not entitle guests to a refund or compensation unless the expedition is cancelled entirely. 

13. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of the Philippines.

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Palawan, Philippines.

14. Amendments

Salty Souls reserves the right to update or amend these Terms and Conditions at any time.

The version in effect at the time of booking shall apply to that reservation.
